Conditions of the passages
1 .- For each passenger NAVIMAG FERRIES S.A. must issue a passenger ticket.
2 .- The passage contains ticket and show the Passage Contract. Must be delivered to the passenger at the time of purchase and it should take it all the way and time to last the journey for which it was issued.
3 .- The passenger ticket must be displayed by the passenger at all times it is required by NAVIMAG FERRIES S.A. and / or the Maritime Authority at the time of shipment, for navigation and landing.
4 .- The passenger ticket is valid only for the vessel, the trip and the passenger indicated there. Therefore, a traveler who does not exercise the power to postpone or cancel the trip as outlined below, and not just embarking on the trip and hired ship loses all rights on it.
5 .- The ticket is issued nominative not be transferred by the passenger to another person, without the prior written Navimag Ferries S.A.
6 .- Passengers wishing to postpone the date of travel indicated in a subsequent passage for swapping, you must make a request to the company with a minimum of 48 hours prior to departure of the ship, having to pay in such cases for the company to make effective the postponement, 10% of the value of the ticket. However, Navimag Ferries S.A. may accept the delays that are required after the 48 hours prior to departure of the ship, provided they are with a minimum of three hours prior to departure and if the passenger pays 50% of the ticket. Beyond these situations, the passenger has no right to postpone the date of travel, for all purposes deemed to be abandoned its completion, to apply the rules laid down for such a situation.
7 .- Passengers may desist from the conduct of the trip, in completing the journey in the opportunities that are outlined below and is subject to the following conditions apply to the same passage, or at escrow:
a) 15 days before the date of departure of the ship on schedule, 10% retention.
b) Between 14 days and 5 days prior to departure of the ship, 30% retention.
c) Between 4 days and 48h and the departure of the ship, 70% retention
d) Between 48 hours and the departure of the ship, 90% retention.
e) After the departure of the ship, 100% retention.
The rates of withholding taxes mentioned above, will be made on the total value of the ticket booked, both for retention as obviously to the same passages.
8 .- It is forbidden to carry passengers or cabin firearms, explosives or any dangerous objects are within the scope of the Gun Control Act or any law amended it. Passengers will be responsible for any damages resulting from the fact or try to bring these objects.
The members of the armed forces and police for reasons of their profession carry weapons are required to declare and give them ammunition in the custody and Captain of the ship to embark as passengers.
Restrictions apply equally to civilians allowed to carry weapons.

9 .- passengers arriving on their own the vessels of the Company or temporarily interrupt the crossing at intermediate ports, must bear the expenses of their stay on land, as well as all expenses for boarding and disembarkation and taxes, if any.
When the passenger fails to board the pre-set time for shipment at the port of departure or in one of scale, or when it is voluntarily landed, the Captain may undertake the journey and the amount of passenger demand, with excluding the value of food.
10 .- "The Company" reserves the right not to take on board those passengers who suffer from any illness, whether mental or otherwise, which may put the safety of the ship, crew or other passengers. For this purpose, passengers must declare, before boarding the ship, diseases that affect them. If not permitted for embarkation on the grounds above, the Company will return the total value of the ticket has been paid.

12 .- All berths vacant, except when the entire cabin has been booked and the amounts of paid, may be employed in intermediate ports. Each berth is hired on the condition that the passenger can be moved, if necessary, a berth to another except when the entire cabin has been booked and the amounts of money.
13 .- Passengers must pay for all purchases and consumption on board, not included in the package. Payment must be in cash and the time of purchase.
14 .- The Company does not carry goods under the name of luggage, which only covers the personal property carried in suitcases, bags, backpacks, boxes and small handbags.
15 .- Navimag Ferries S.A. is not responsible for loss or damage of money, negotiable securities, jewelry or valuable items, such as gold or silver bars, coins or plates, cutlery or utensils made of precious metals or other similar nature, unless been delivered to the storage conveyor. In this case, Navimag Ferries S.A. be responsible solely to the legal limit.
16 .- No animals are allowed on the vessels of the Company except under special arrangements.
17 .- Every passenger is expressly forbidden him access to the cargo area.
18 .- Passengers are required to comply with all regulations and rules established by the Company with respect to carriage of passengers and their property, and the orders of the captains on board the ships.
19 .- The carrier may cancel the sailing of the ship in case of force majeure or act of God, not being the passenger in this situation right to the refund of the ticket paid in compensation or damages of any kind. In case of delay in departure of the ship or delay in arriving at its destination, the passenger will be entitled during the delay period, accommodation and food on the ship if it is included in the agreed price of the ticket. However, if the delay in departure or arrival is due to causes beyond the carrier's responsibility, the passenger is not entitled to seek reimbursement of the ticket and / or compensation for any damage which has undergone. When the voyage is interrupted temporarily causes the carrier, the passenger will be entitled to accommodation and food, without Navimag Ferries S.A. may require an additional payment. 20 .- The vessel may sail any route into and out of any port with or without pilots or tugs, tow or be towed, and assist other vessels in all situations, arriving back to port, and to deviate scale at any port for any order, whether or not they are out of order or direct or normal course of the voyage and, if required to do so by seeing to quarantine or other governmental or municipal or other force majeure, may without prejudice to any other right or power conferred by these conditions, fail to call the fixed ports on the itinerary without incurring liability for any consequences of such deviation or omission.
21 .- The date and time of departure indicated in the passenger ticket is an attempt. The passenger must confirm shipment with 48 hours prior to departure. Navimag Ferries S.A. not responsible for the delay in the departure of the ship, whether it is due to force majeure or fortuitous event.
22 .- When the voyage or any part of total travel and other services detailed in the ticket, provided they are otherwise getting the Company to issue this ticket it only hires those services as an agent of the person, firm or entity provides such services. And all contracts made by the Company as an agent shall be subject to the regulations and conditions of said person, firm or entity.
23 .- In addition to any other right or power conferred by these conditions, the Company is free to cancel all of its obligations arising from the passenger, thus excluding any obligation to repay the amount or pay damages the passenger by reason of force majeure or fortuitous event. Be considered in any event of force majeure or fortuitous event in the event that the Chilean government or any other government requise the ship or the passenger accommodation in the same or any part thereof, or if, in the opinion of the Company or the Captain, the imminence or existence of a state of war or any military operations or hostilities (whether war or not the Republic of Chile), or riots, civil commotion (háyanse declared or not), congestion in ports and docks, labor disturbances or interruptions, or other causes beyond the control of the Company, interfere with the proper enforcement of these obligations, or whether those causes or circumstances make compliance impractical or dangerous to the masses.
24 .- However, the designation of the port of destination on the ticket, if that order or request from any authority or who appears as competent to issue such order or request, or given under the terms of the war risk insurance of the ship, for whatever reason it was diverted to any port other than the destination named in this bill, the obligations of the Company under this contract should be interpreted as the port where the ship is would be diverted found indicated in this ticket instead of the port of destination in the specified. 25 .- In addition to the powers expressly or implicitly contained in the ticket, the vessel is free to comply with any order or instruction regarding the loading, departure, routes, ports of call, stoppages, transshipment, landing, arrival or any others that may be issued by the Chilean Government, or any department thereof, or any other government or person acting or presenting himself as acting with the authority of that Government, or any committee or person pursuant to the terms of the War risk insurance on the vessel are entitled to give such orders or instructions.
Any act done or not done by reason or in pursuance of such orders is best understood within the Passage Contract. 26 .- If the vessel referred to in this note (or any substitute thereof) is not owned, leased or chartered by NAVIMAG FERRIES SA (as the case may be, notwithstanding any appearance to the contrary) is agreed, notwithstanding any other provision in this bill, which NAVIMAG FERRIES SA can benefit in any case to any rights, immunities and liability exclusions or limitations of any nature that are or may be, since these conditions apply to owners or charterers rented under any laws, orders, regulations or requirements of "Common Law".
27 .- In all of these conditions do not specify explicitly Passage shall apply the provisions of Book III of the Code of Commerce and its laws and amendments. In the event of inconsistencies between these Conditions and the Commercial Code or the laws or modifying the latter shall prevail.
